With the National Guard on the job, one man has been killed,^one wounded,^both non-union miners. But the authorities sa^d these casualties had nothing to do with the scrap between the unions and non-union men. They were purely personal affairs. Six of the forty—two soft coal mines in HarlanCounty started operating again with Governor Happy Chandler’s guardsmen patrolling the district. A big spectacle in bloody Harlan was a procession of motor cars two miles long, full of union miners in their working togs. They drove from one mining community to another but at several road-crossings they were stopped and headed the other way by National Guard patrols. SUPREME COURT The Constitution of the United States(^osp«ar has a sentence in the Bill of Rights which forbids Congress or the states to interfere with the right of any A to bear arms. That clause has been frequently called upon as a stumbling block in the path of the police. The^w^j^ave done their utmost to get laws passed to make it difficult for anybody but peace officers to obtain deadly weapons. The National Firearms Act is one of those laws. It forbids anybody from transporting machine guns, sawed off rifles or sawed off shotguns which have not been registered. Under that act a couple of men were arrested in Arkansas, charged with carrying an unregistered sawed off shotgun from Claremore, Oklahoma, to Siloam, Arkansas. Their lawyers tried to get them said the act was unconstitut ional. A judge of the federal district court in western Arkansas agreed with thoW lawyers, ^quashed the indictment. The government appealed , and today the United States Supreme Court took the side of ita law and order. The National Firearms Act is not unconstitutional^ says the court in an opinion written hy Mr. Justice McReynolds. Every member of the court agreed with him.
