THIS INDENTURE, made the 31st day of July, nineteen hundred and seventy-two between WILDWYCKE VILLAGE, INC., a New York Corporation, having its offices on Route 9W, Esopus, New York, party of the first part, and ALEXANDER J. ZABIK and FUMIKO ZABIK, his wife both residing at 4 Ona Lane, New Windsor, N. Y. party of the second part,
WITNESSETH, that the party of the first part, in consideration of TEN and No/100 ($10.00) dollars, lawful money of the United States, and other good and valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever,

All. that certain plot, piece or parcel of land, lying and being in the Town of Esopus, County of Ulster, State of New York, more particularly bounded and described as follows:

BEGINNING at a steel survey marker set in the southerly boundary of the lands of Wildwycke Village, Inc. at the intersection of the said boundary with the westerly boundary of the New York State highway (Route 9W); thence North 21 degrees 38 minutes West along the said highway boundary 431.82 feet to a steel pin; thence South 82 degrees 17 minutes West 62.65 feet to a steel pin; thence North 25 degrees 08 minutes West 446.45 feet to a steel pin; thence North 58 degrees 08 minutes West 154.71 feet to a steel pin; thence North 82 degrees 08 minutes West 266. feet, plus or minus, to the shoreline of Black Creek; thence southerly along the said shoreline 605 feet, plus or minus, to a point in the aforementioned southerly boundary of the lands of Wildwycke Village, Inc., said point being 8.6 feet distant, plus or minus, measured on a bearing of North 6.6 degrees 55 minutes 50 seconds West from a steel pin; thence along the old wire fence and stone wall marking the said boundary as follows: South 66 degrees 55 minutes 50 seconds East 60 feet, plus or minus; and thence South 66 degrees 45 minutes 20 seconds East 740.3 feet; and thence South 67 degrees 21 minutes 30 seconds East 376.99 feet; and thence South 65 degrees 52 minutes 40 seconds East 99.90 feet to the point of beginning, containing 10.4 acres of land, be the same more or less.

BEING a part of the premises conveyed by Walrus, Inc. to Phillip P. Hellriegel and James R. Shields by deed dated November 5, 1968, recorded November 8, 1968 in the Office of the Clerk of Ulster County in Liber 1220, Page 448 and thereafter conveyed by Phillip P. Hellriegel and James R. Shields to c4ildwycke Village, Inc. by deed dated August 12, 1969 recorded September 11, 1969 in the Office of the Clerk of Ulster County in Liber 1232, Page 1178.

SUBJECT to a restriction that the property may be used for any commercial purpose except that if said property is used as a restaurant, such restaurant shall be a Japanese type restaurant.

Together with an easement to the Purchasers for a right of way, entrance of the property of the Seller.

SUBJECT to an agreement between the parties that the Party of the First Part is to have the use of the well on the demised premises, without cost, for a period of one year from the date of closing of title, with the understanding that the Party of the First Part shall maintain said well during that time, at its own cost and expense.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof.

TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises.

TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever.

AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid.

AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.

The word "party" shall be constr5ued as if it read "parties' whenever the sense of this indenture so requires

Zabik and Fumiko Zabik, his wife, residing at Route 9W, West Park, Town of Esopus, Ulster County, New York, party of the first part, and Andre L. Dionne, residing at Drake Road, Route 4, Box 403, Pleasant Valley, New York, party of the second part,

Witnesseth that the party of the first part, in consideration of TEN ($10.00) dollars, lawful money of the United States, and other good an valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever,

All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Esopus, County of Ulster, State of New York, being more particularly bounded and described as follows:

BEGINNING THENCE along said division line North 65° 14' 15" West 99.90 feet; thence continuing along said line North 66° 42' 50" West 376.99 feet; thence still continuing along said line North 66° 06' 45" West 740.30 feet to a point; thence still continuing along said line North 66° 17' 15" West 59.71 feet to a point ; . RUNNING THENCE along the division line between the premises herein and lands now or formerly of Peter Brill described in Deed Liber 1438 at page 88, which line is also along the approximate apparent shoreline of Black Creek

North 75° 26' 10" East 94.27 feet; North 87°19' 40" East 40.82 feet;
North 78° 30' 40" East 104.47 feet;
North 58° 04' 45" East 98.08 feet; North 40° 45' 25" East 52.20 feet;
North 18° 37' 40" East 87.41 feet;
North 10° 42' 05" East 103.03 feet;
North 02° 27' So" East 59.78 feet; and
North 08° 06' 50" West 40.47 feet to a point ;

THENCE still continuing along the division line between the premises herein described and lands now or formerly of Brill hereinbefore mentioned am running in a generally easterly direction

South 80°391 30" East 259.76 feet;
South 56° 271 20'1 East 154.74 feet to a point;

thence South 23° 261 40" East 447.08 feet; and North 83° 081 20" East 63.27 feet to a point on the westerly side of New York State Route 9W;

RUNNING THENCE along the westerly side of said highway;
South 19° 531 35" E.1St 431.82 feet to a point and place of BEGINNING.

SUBJECT to covenants, easements and restrictions of record.

BEING and intended to be the same premises described in that certain deed dated the 31st day of July, 1972 from WILDW\YCKE VILLAGE, INC. to ALEXANDER J ZABIK and FUMIKO ZABIK, his wife, and recorded in the Ulster County Clerk's Office on the 3rd day of August, 1972 in Liber 1283 at page 101.

ALSO, granting a right of way for ingress and egress to and from the above described premises and New York State Route9W, which right of way is more particularly described as follows:


Beginning at a point marked by a set iron rod in the westerly bounds of N.Y.S. Route 9W. Thence from said point of beginning, along the westerly bounds of said Route 9W, N 19° 53' 35" W 49.19' to a point. Thence through lands of said Peter Brill, S 83° 08' 20" W 66.45' to a point in the bounds of lands of Alexander J. Zabik. Thence along Zabiks line, S 23° 26' 40" E 50.00' to a point marked by a found iron rod. Thence still along Zabik, N 83° 08' 20" E 63.27' to the point and place of beginning. Being the "South Entrance" as mentioned in Liber 1283 of Deeds at Page 101.

Together with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof,

Together with the appurtenances and all the estate and rights of the party of the first part in and to said premises

To have and to hold the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever.

And the party of the first part covenants that the pary of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid.
